All work is carried out by Everything Local Publishing on the understanding that the client has agreed to Everything Local Publishing Ltd terms and conditions.
Copyright is retained by Everything Local Publishing Ltd on all design work including words, pictures, and ideas.
Please remember any business or person/persons who agree to have their details published in one of Everything Local Publishing Ltd A5 magazines are entering into a verbal/written contract. Any business advertising in the Everything Local community guides are paying for one edition of that particular publication unless otherwise agreed with Everything Local Publishing Ltd. Our Flintshire edition produces 10,000 printed copies every month, the Cheshire edition produces 5,000 printed copies every month, and Denbighshire, Conwy, Bi monthly edition of the magazine is producing 5,000 printed copies. Depending on the advertising package agreed with the business or customer Everything Local Publishing Ltd will also upload the business details onto the agreed amount of network of websites only if the required information is supplied by the paying advertiser, please allow up to 14 days from magazine distribution date for your details to be uploaded onto the network websites selected.
Everything Local Publishing Ltd reserve the right to alter the print run on any magazine due to circumstances beyond our control.
This can include not enough adverts being sold for the specific region.
In any event the minimum production will be 5,000 printed magazines per edition including Flintshire.
Everything Local Publishing Ltd will notify the customer in advance if they have a booking pre ordered, or paid for upfront and offer an alternative edition to compensate any shortfall in production of the version the Company or business is to appear in.
This will not affect the online editions of the magazines currently at 81 current versions of the magazines every month.
Everything Local Publishing Ltd do however reserve the right to take down any web content containing its own marketing and offers at any time including the online magazines without notice also including the perfect binding of any magazine.
The above have always been promotional added materials with no extra costs being passed on to any customer of Everything Local Publishing Ltd, including increased production of publications.

Everything Local Publishing gives no guarantees after a full SEO is performed for any customer or business it will be successful. Everything Local publishing Ltd also as per advertising package agrees to upload the particular business on your business booster website uploading promotion, discounts, or offers the particular business is promoting during the period of the advertisement only, it is up to the advertising business to provide details of the offers or promotions the business is running, to be uploaded onto the business booster website.
No guarantees are given after any insertion of any business offers promotions or discounts onto your business booster website will result in success. Your business booster is a website built solely for businesses who advertise with Everything Local Publishing Ltd only to further showcase their particular products.
Any business, person or persons who cancel their order once the cancellation period of 7 days has expired are liable to the full price of the advert as the space was pre booked.
Everything Local Publishing Ltd reserve the right to chase all outstanding monies when the 7 day cooling off period has expired in the exception a business that places order for advertisement within the 7 days of the particular magazine being printed a 48 hour cooling off period applies, Payment terms for credit based advertisements is on a 7 day basis unless agreed in writing by both parties. Independent businesses and international companies must pay prior to publication being published via credit/debit card or bacs, all advertising must be paid for before the edition of the community guide your advert is to appear in goes to print, unless otherwise stipulated with an agreement with Everything Local Publishing Ltd, we reserve the right to chase any account that is outstanding after the magazine has gone to print, if payment is not received within the allocated terms your account may be outsourced to a debt recovery agency to recover any monies owed.
Any company artworks designed by us the publishers may only be used in the publication and it is for no other use. If the artwork is used in any other manner Everything Local Publishing Ltd reserve the right to request a fee for the artwork designed. All artworks designed by Everything Local Publishing Ltd remains the intellectual property of Everything Local Publishing Ltd. We the publishers cannot be held responsible for any downtime on the websites due to maintenance or updates, or if the websites are removed for any other reason. The amount of pages published is governed by the amount of advertisers placing an advert in a particular publication; minimum amount of pages will be 20 per publication and will increase with the extra demand for advertising space purchased by businesses, wishing to advertise within the publication.
The customer or business acknowledge that Everything Local Publishing Ltd (The Supplier) may record telephone calls between the parties and may rely on such records in any dispute between the parties over existence, construction or otherwise of the contract. We the publishers reserve the right to chase all payment once the cancellation period of 7 days has expired. You have 7 days unless otherwise stated due to deadlines been met to amend or approve your artwork if artwork is not amended in the allotted time the artwork we have on file or have drawn up for you will be used when going to print. In certain circumstances at the discretion of Everything Local Publishing Ltd if artwork amendments are not submitted before going to print as per communication with the customer, that particular business will be rolled over to the next edition of the publication and all monies outstanding from the original invoice will be due to be paid in full or cancellation fees will apply. Please note any details or data Everything Local Publishing Ltd are provided by a business or organisation will under no circumstances be passed to a third party organisation, without the participated business or organisations written permission to do so, we treat all correspondence and data confidential and business or organisations details are only used for advertisement purposes in the particular publication of which the business or organisation has agreed to appear within.
We do our up most not to contact businesses who have registered with government or affiliated agencies opt out ledgers. Everything Local Publishing Ltd reserve the right to contact any participating organisation or businesses that have advertised previously, regarding future promotions or advertising opportunities, until Everything local Publishing Ltd are notified by present or previous advertisers not to do so, in writing. Advertisers remember all cut off periods for artwork and payment are at the end of each second week of each calendar month, this enables Everything Local Publishing Ltd time to amend any incorrect artwork and produce the publication. Your business will not appear in The Everything Local community guide until the next edition is published if any deadlines are missed but may still be charged up front times of distribution may vary.
We the publishers reserve the right to place advertisers within the publication, into larger geographical regions including their own geographical region if advertising space for their region has not been filled to the publishers minimum requirements. The Everything Local community guide and any trademarks are solely owned by Everything Local Publishing Ltd and may not be used without written agreement from Everything Local Publishing Ltd to do so.
All publications sent to business advertisers are distributed by 1st class Royal Mail. For any business that does not receive a copy of their publication, another copy will be sent upon notification for the particular business, the second copy will always be sent by Royal Mail 1st Class recorded delivery.
Any business who supply their business logo to Everything Local Publishing Ltd, or fail to approve, or amend the proposed artwork, accept that the proposed artwork will be used for the entry into the publication. We do not accept any responsibility if we are not contacted in due course via: Telephone, email or in writing stating the fact the artwork is incorrect. It is the advertising businesses responsibility upon receiving any proof copy or a notification to ensure the proposed artwork is correct and adequate. Everything Local Publishing Ltd is not responsible for the content of links external to our website, or any misinformation which is supplied to ourselves and appears in any of our publications. Please note Everything Local Publishing and the Everything Local community guides are not associated with Trinity Mirror, Northwest & North Wales Limited or associated with any other newspaper or magazine.
Any legal action brought against Everything Local Publishing Ltd, arising from an advertisement published in accordance with copy instruction supplied by the advertiser, the advertiser will indemnify Everything Local Publishing Ltd fully in respect of costs and damages that may occur in result of legal action.
All advertisements must comply with the British code of advertising practice, we reserve the right to refuse adverts that may be defamatory or offensive.
Website Design Quotation acceptance
At the time of proposal, Everything Local Publishing Ltd will provide the customer with a written estimate or quotation.
A copy of the written estimate or quotation is to be signed and dated by the customer or the business appropriate authorizing person/persons to indicate acceptance and should be returned to Everything Local Publishing Ltd. Alternatively, email acknowledging acceptance of the quotation is also recognized as acceptance. No work on a project will commence until acceptance of the quotation has been received by Everything Local Publishing Ltd.
Charges for design services to be provided by Everything Local Publishing Ltd will be set out in the written estimate or e mail that is provided to the customer. At the time of the customer’s signed acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 50% of the quoted fee will become immediately due. Work on the project will not commence until Everything Local Publishing Ltd has received this amount.
Unless agreed otherwise with the Client, all design services require an advance payment of a minimum of fifty (50) percent of the project quotation total before the work is supplied to the Client for review. The remaining fifty (50) percent of the project quotation total will be due upon completion of the work prior to upload to the server or release of materials.
Charges for Other Services
Charges for any additional services over and above the estimated design, will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.
Everything Local Publishing Ltd reserve the right to chase any accounts which remain outstanding for 30 days after the date of invoice, or upon completion of the project especially if the project has been uploaded to the server and has been built to the customers original specification. Any further alterations to the said project if not agreed within the original contract will be subject to additional charges unless otherwise agreed but all monies as above must be paid in full before any alterations are done in any instance to the original project. Publication and/or release of work done by Everything Local Publishing on behalf of the client, may not take place before cleared funds have been received.
Returned cheques will incur an additional fee of £30 per returned cheque. Everything Local Publishing Ltd reserves the right to consider an account to be in default in the event of a returned cheque.
An account shall be considered in default if it remains unpaid for 30 days from the date of invoice, or being uploaded onto the server and being completed. This includes any alterations still required as per original agreement; alterations will only be done when all funds for the project have cleared. Any returned cheques will also be deemed also as default
Everything Local Publishing Ltd shall be considered entitled to remove Everything Local Publishing Ltd and the customer’s material from any and all computer systems, until the amount due has been fully paid. This includes any and all unpaid monies due for services, including, but not limited to, hosting, domain registration, search engine submission, design and maintenance, sub-contractors, printers, photographers and libraries, magazine advertising.
Removal of such materials does not relieve the customer of its obligation to pay the due amount. Customers whose accounts become default agree to pay Everything Local Publishing Ltd reasonable legal expenses and third party collection agency fees in the enforcement of these Terms and Conditions.
Copyrights and Trademarks
By supplying text, images and other data to Everything Local Publishing Ltd for inclusion in the customer’s website or other medium, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner.
Any artwork, images, or text supplied and/or designed by Everything Local Publishing Ltd on behalf of the customer, will remain the property of Everything Local Publishing Ltd and/or its suppliers.
By supplying images, text, or any other data to Everything Local Publishing Ltd, the customer grants Everything Local Publishing Ltd permission to use this material freely in the pursuit of the design. Should, Everything Local Publishing Ltd or the customer supply an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the customer will agree to allow Everything Local Publishing Ltd to remove and/or replace the file on the site.
The customer agrees to fully indemnify and hold Everything Local Publishing Ltd free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.
The customer also agrees that Everything Local Publishing Ltd holds no responsibility for any amendments made by any third party, before or after a design is published unless otherwise agreed between parties.
Any design, copywriting, drawing, idea or code created for the customer by, Everything Local Publishing Ltd or any of its contractors, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Everything Local Publishing Ltd and any of its relevant sub-contractors.
All design work – where there is a risk that another party make a claim, should be registered by the client with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use. Everything Local Publishing Ltd will not be held responsible for any and all damages resulting from such claims. Everything Local Publishing Ltd is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold Everything Local Publishing Ltd responsible for any such loss or damage. Any claim against Everything Local Publishing Ltd shall be limited to the relevant fee(s) paid by the customer.
Design Project Duration
Any indication given by Everything Local Publishing Ltd of a design project’s duration is to be considered by the customer to be estimation. Everything Local Publishing Ltd cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds are received by Everything Local Publishing Ltd for the initial payment or by date confirmed in writing by. Everything Local Publishing Ltd
Rights of Access for Website Construction
The client agrees to allow Everything Local Publishing Ltd all necessary access to computer systems and other locations, as required, in order to complete a website project and until all due funds are cleared, including the necessary read/write permissions, usernames and passwords. The customer also agrees to allow Everything Local Publishing Ltd access to any computer systems, usernames and passwords required to remove data and/or sites for failure to comply with these Terms and Conditions. The customer agrees to supply Everything Local Publishing Ltd with all necessary materials, electronic, or otherwise, required to create and complete the project, and to supply them in a timely manner.
Website design only
Everything Local Publishing Ltd enquire that a template is approved by the customer before coding of a site commences. Once the template(s) for the web site are approved by the customer, coding will commence; any changes to navigation items, colours, structure or content that requires changes to the template will incur an additional charge unless otherwise agreed.
Once web design is complete, Everything Local Publishing Ltd will provide the customer with the opportunity to review the resulting work. Everything Local Publishing Ltd will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to Everything Local Publishing Ltd by e-mail or fax and confirmed by post.
Everything Local Publishing Ltd will consider that the client has accepted the original draft, if no notification of changes is received in writing from the customer, within 14 days of the start of the review period.
Everything Local Publishing Ltd offers limited in-house hosting services through an out-sourced virtual server. Everything Local Publishing Ltd does not guarantee continuous service and will accept no liability for loss of service, whatever the cause. Everything Local Publishing Ltd may request that clients change the type of hosting account used if that account is deemed by Everything Local Publishing Ltd to be unacceptable because of poor service, lack of bandwidth or in any other way insufficient to support the website. Fees for hosting on Everything Local Publishing Ltd virtual server are due at the commencement of any period of service and are non-refundable. Fees due to third party hosting organisations are the responsibility of the client and Everything Local Publishing Ltd is not liable for their payment, or for the renewal of domain names, which are the sole responsibility of the customer / domain owner
Everything Local Publishing Ltd cannot guarantee the availability of any domain name. Where Everything Local Publishing Ltd s to register a domain name on behalf of a client it will endeavor to do so but the client should not assume a successful registration.
Search Engine Submission
Due to the infinite number of considerations that search engines use when determining a site’s ranking, Everything Local Publishing Ltd cannot guarantee any particular placement. Acceptance by any search engine cannot be guaranteed and when a site is accepted, the time it takes to appear in search results varies from one search engine to another. Rankings will also vary as new sites are added Everything Local Publishing Ltd recommend that customers use a professional SEO company and are happy to provide details of such companies, but accept no responsibility for their services.
The customer agrees to allow Everything Local Publishing Ltd to place a small credit on printed material exhibition displays, advertisements and/or a link to Everything Local Publishing Ltd own website on the customer’s website. This will usually be in the form of a small logo or line of text placed towards the bottom of the page.
The customer also agrees to allow Ever Everything Local Publishing Ltd to place websites and other designs, along with a link to the client’s site on own website for demonstration purposes and to use any designs in its own publicity and portfolios.
Rights of Refusal
Everything Local Publishing Ltd will not include in its designs, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities. Everything Local Publishing Ltd also reserves the right to refuse to include submitted material without giving reason. In the situation where any images and/or data that Everything Local Publishing Ltd does include in all good faith, and subsequently discovers is in contravention to such Terms and Conditions, the customer is obliged to allow to remove the contravention without hindrance, or penalty. Everything Local Publishing Ltd is to be held in no way responsible Everything Local Publishing Ltd for any such data being included.
Cancellation of orders may be made initially by telephone contact, or e-mail, however, following this, Everything Local Publishing Ltd will need formal notification in writing to the company’s postal address. The client will then be invoiced for all work completed over and above the non-refundable deposit that will have been made at the time of first ordering. The balance of monies due must be paid within 30 days. Please note: any cancellation which is not formally confirmed in writing and received by Everything Local Publishing Ltd of 14 days of such instruction being issued, will be liable for the full quoted cost of the project
Everything Local Publishing Ltd makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Everything Local Publishing Ltd will not be held responsible for any and all damages resulting from products and/or services it supplies. Everything Local Publishing Ltd is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Everything Local Publishing Ltd responsible for any such loss or damage. Everything Local Publishing Ltd reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. 2. Employees of Everything Local Publishing Ltd or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
3. There is no entry fee and no purchase necessary to enter this competition.

5. Closing date for entry will be published within the relevant magazine. After this date no further entries to the competition will be permitted.
6. No responsibility can be accepted for entries not received for whatever reason.
7. The rules of the competition and the prize for each winner can be changed at any time under the discrepancy of Everything Local Publishing Ltd.
